Where data is being transferred from the EEA to other countries, we shall comply with legal frameworks that ascertain an equivalent level of protection with European Union law.
b) EU-US and Swiss-US Privacy Shield frameworks
We shall comply with the EU-US and Swiss-US Privacy Shield Frameworks as set forth by the US Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries and Switzerland, respectively.
c) Model Contract Clauses
The Organization shares personal information within the Organization and to other trusted businesses or persons to process it for us, based on our guidelines and in compliance with this Privacy Policy and any other appropriate confidentiality and security measures. Your information may be transferred, or stored and processed in other countries outside of where you live for the purposes as described in this Privacy Policy. These data transfers are necessary to provide the services to you and to globally operate and provide our products to you. We utilize standard contract clauses, rely on the European Commission's adequacy decisions about certain countries, as applicable, and obtain your consent for these data transfers to other countries.

PROGRAM TERMS and CONDITIONS
These Program Terms and Conditions, together with the General Terms of Use and the Privacy Policy, make up the entire agreement between the User and “El Arte de Vivir” ("Organization"). "User" means the consumer of this website and potential participant in one or more learning programs administered by the Organization ("program" or "programs"); or to the user of this website and parent or legal guardian of a potential participant under 18 years of age in one or more learning programs administered by the Organization.
Please try to read carefully before agreeing.
1. USER/PARTICIPANT ENGAGEMENT:
- The user understands that any benefit derived from the program depends exclusively on the degree of participation. He/She takes full responsibility for the results of taking the program and willingly agree to follow all instructions and participate fully.
- The user will not disclose the content of the program to anyone. He/she will not attempt to instruct others in the techniques used during the program until he/she has received the corresponding training as an instructor from the Organization and is certified by the Organization to teach the program.
- The user understands that he/she is not authorized to disclose the content of any program or any of the conditions provided by the Organization to any third party without the written authorization of the Organization. He/she also confirms that the techniques and exercises of the Learning Organization constitute private and confidential information and, therefore the user: 1) will not share this information with anyone or teach this information to others, unless he/she has the written permission of the Organization; 2) will not practice the techniques and exercises outside the Organization's program environment unless he/she receives instructions from the Organization's instructor. The user also understand that the contents of the Organization's programs constitute the intellectual property of the Organization, and that he/she will be liable under applicable law for any unlawful use, disclosure, copying, modification or creation of derivative works of the contents unless explicitly authorized by the Organization.
Except as otherwise provided, nothing contained herein shall apply to any confidential information, program content or technique of the Organization, which is or will subsequently be made available to the public other than by the failure of the receiving party to commit to this User Agreement; or which is approved for disclosure by written authorization from the Organization.
2. IMAGE USAGE
The Organization may publish group images captured in the development of the activities with a solely educational and informative purpose of the activities carried out in the different centers of the Organization, constituting the content of the communication of each center and its social networks. The User, in these terms, authorizes the capture and reproduction of the images in which he/she may appear.
3. PAYMENT METHODS
The accepted means of payment are: debit card, credit and cash. In the latter case (cash), payment can be made by “RapiPago” and “Pago Fácil”, through “Mercado Pago”.
4. MODALITY OF COURSE PROVISION
The courses included in The Art of Living are carried out online and / or face-to-face, as indicated in the description of the courses found on the Organization’s website.
5. APPLICABLE LAW
This agreement is governed by the laws of the Republic of Argentina and shall be subject to the exclusive jurisdiction of the Courts of the City of Buenos Aires. Any failure to comply with any provision of this Agreement shall not constitute a waiver thereof or any other provision thereof.
REFUND POLICY
All refund requests should be addressed to the email devoluciones@elartedevivir.org.
Once the program/course has been paid, the user has a period of ten (10) days to request the cancellation of the purchase and the full refund of the amount paid.
After the aforementioned period, refund requests received before the start of the planned program/course will be accepted and made with a charge of 10% -of the value of the program/course- as an administrative expense, except when the courses are canceled or rescheduled by the Organization, in which case the entire amount paid by the participant will be refunded.
Once the program/course has begun, the value of the course is non-refundable.
In the event that a participant has paid for the program/course, but does not attend, the full value thereof may be transferred to another person or course of the same type up to 90 days after the end of the original course, provided that the Organization is notified of this circumstance within 20 days of the start of the program/course to which they intend to transfer. In the event that an increase in the price of the course is generated, within the aforementioned period, the difference will be borne by the participant.
Refunds are made by the same means that the payment was made. In the case of courses paid in cash through “RapiPago” and “Pago Fácil”, the refund will be made to an account in “Mercado Pago”.
DISCLAIMER-ASSUMPTION OF RISK-INDEMNITY AGREEMENT
As a condition for, and in consideration of the right to participate in any way in any program provided by the Organization, the user understands and agrees as follow:
- The nature of the Organization's programs requires that he/she be qualified, in good health and in proper physical condition to participate in such programs. If, at any time, the user believes or is advised that the conditions of a program may be unsafe for him/her, the user will immediately discontinue further participation. He/She declares that in case of suffering from any conditioning illness (physical or mental), the user will inform the course authorities prior to the start of the course or at the time of becoming aware of the illness;
- Organization programs involve risk of personal injury which may be caused by the user’s own actions or inactions, the actions or inactions of others participating in the programs and/or the conditions in which the programs are carried out. The user further understands that there may be other social and economic risks or losses that are not known or are not easily foreseeable at this time ("Risks");
- The user fully agrees to assume all risks and all liability for any losses, costs and damages he/she may suffer as a result of his/her participation in the Organization programs.
By means of this agreement, the participant releases and agrees not to sue or hold the Organization, its affiliates, administrators, directors, agents, officers, members, volunteers and employees, other participants, officers, owners and tenants of the premises in which the programs are carried out (the "Released Parties") responsible in any way of any liability, claims, demands, losses or damages on account caused or alleged to be caused, in whole or in part, by the acts, omissions or negligence of any of the Released Parties and acknowledges that he/she agrees that if, despite such release of liability, assumption of risk and indemnification agreement, any person on his/her behalf, makes a claim against any of the Released Parties, will indemnify, hold each of them harmless from all litigation expenses, attorneys' fees, loss, liability, damage or cost he/she may incur as a result of such claim.
The services provided by the Organization are provided on an "as is" and "as available" basis, without warranty or condition. The user waive all special, indirect and consequential damages against the Organization. These terms shall not limit the non-waivable warranties or consumer protection rights to which the user are entitled under the mandatory laws of his/her country of residence.
By selecting the "yes" box and accepting this waiver, the user acknowledges that he/she is at least 18 years of age, or that he/she is a parent or legal guardian of the participant under the age of 18 in which case the user agrees to identify his/her self in the manner required by the Organization; that the user has carefully read and fully understands this disclaimer, assumption of risk, indemnification and release agreement; understands that the user has waived substantial rights by accepting this waiver; that she/he accepted freely and without any prompting or assurance of any nature, and that it is a complete and unconditional waiver of all liability to the fullest extent permitted by law; User agrees that if any part of this Agreement is held invalid, the balance will nonetheless continue in full force and effect.
